General Release Agreement
ALL PARTICIPANTS IN Baltimore Running Festival (‘Event’) ARE REQUIRED TO ASSUME ALL RISK OF PARTICIPATION BY ACCEPTING THIS GENERAL RELEASE AGREEMENT.
I know that running is a potentially hazardous activity. I should not enter and run unless I am physically fit, medically able and properly trained. I agree to abide by any decision of a race official relative to my ability to safely complete the run. I hereby certify I am in good health, and I have trained to run the distance of the race that I am entering. I assume all risks associated with running this event, all risks being known and appreciated by me. Having read this waiver and knowing these facts and in consideration of your accepting my entry into this running event, I, for myself and anyone entitled to act on my behalf, waive and release Corrigan Sports Enterprises, Burns Computing, their offices, directors, agents, volunteers and employees, the City of Baltimore, Mayor and City Council, Department of Public Works, Recreation and Parks, all sponsors, their representatives and successors, from all claims or liabilities of any kind arising out of my participation in this event even though that liability may arise out of negligence or carelessness on the part of the persons or entities named in this waiver. I grant permission to all of the foregoing to use my photographs, motion pictures, recordings, videos or any other recording of this event for legitimate purpose. I understand that bicycles, skate boards, baby joggers, roller skates or inline skates and animals are not allowed in this event and I will abide by this rule.
Authority to Register and/or to Act as Agent. You represent and warrant to Forte Interactive, Inc. (‘Forte’), TrustedPartner Ecommerce Services and RacePartner (formerly GoRun.org) that you have full legal authority to complete this event registration on TrustedPartner Ecommerce Services, including full authority to make use of the credit or debit card to which registration fees will be charged. In addition, if you are registering third parties, you represent and warrant that you have been duly authorized to act as agent on behalf of such parties in performing this event registration. By proceeding with this event registration, you agree that the terms of this Registration Agreement shall apply equally to you and to any third parties for whom you are acting as agent. You represent and warrant that, in compliance with COPPA, you are over thirteen (13) years of age, and that if you are registering a child under fourteen (14) years of age you are the parent or guardian of such child, and do hereby consent to the collection of such child’s personal information by Forte.
Refund Policy. I acknowledge that my entry fee is non-refundable, including if the race is cancelled, and my entry is non-transferable.
The Baltimore Running Festival does not allow for refunds or transfers of entry fee. We all know that injuries often arise during training after we have registered for a race. The Baltimore Running Festival has deferment and downgrade options if you are able to meet certain requirements. Details are available on our website. If weather or other conditions present a danger to participants, we maintain the right to cancel or modify the race. Public safety officials and medical authorities will be consulted prior to any race cancellation or modification Cancellation is strongly advised when severe thunderstorms with the threat of lightning threatens the course and are forecasted to continue throughout the time frame of the event. Alteration of the course or race length may be implemented to ensure a safer race environment. The above conditions will be recognized as “an act of god” and will not result in the refunding of race entry fees or future race credits
The use of personal music devices is strongly discouraged at this race. To enjoy all that our race has to offer and for the safety of all participants, the Baltimore Running Festival encourages a headphone‐free environment during the running of all its race distances. We believe your race experience and those around you will be greatly enhanced by leaving the headphones at home or in the car. Running headphone‐free allows opportunities to develop camaraderie with your fellow runners and to enjoy everything the race has to offer. Plus, volunteers and spectators will be on course cheering you on and providing directions to help get you to the finish line. Runner safety has always been, and will continue to be, a top priority for our event. Please be mindful of the other participants and respect the race personnel to ensure a safe and enjoyable race for everyone. If wearing an iPod or other audio device results in you being unable to hear verbal instructions or commands; approaching vehicles or course marshals on foot or on bicycles, you may be asked to relinquish the device. IMPORTANT: Those competing in the Baltimore Running Festival for awards or prize money may not use such devices and will not be eligible for any award or prize money if such device is worn. USA Track & Field Rule 144.3, states that the visible possession or use by athletes of video, audio, or communications devices in the competition area (which includes iPods, MP3 and other musical devices) is considered assistance and is therefore are prohibited.
